These terms and conditions include general terms and conditions for use of this Website, and any terms and conditions relating to the sale, purchase and use of our Services.
Please read these terms and conditions carefully. Your use of the Website and the purchase of any of our Services sold on or off this Website will be subject to these terms and conditions. Omega Movement Ltd’s website (the "Website") is designed to provide you with high quality yoga, Pilates, Meditation techniques, coaching, and energy healing practices to improve your general sense of wellbeing. The Website is not intended for those below the age of 18. Please do not use this site if you are under the age of 18.
"Services" means any information, audio and / or audiovisual content, photos, articles, online and in-person lessons, healing sessions, retreats, workshops, classes, packages, programs and courses and services ordered and/or provided by the Omega Movement Ltd through or via the Website and any and all our third party instructors, employees or authorised agents, and all services offered as part of our wellbeing packages or when viewed as a Visitor. Any electronic information supplied to you by the Omega Movement will constitute part of Service not a product and any cancellation rights will apply and be interpreted accordingly.
1. Acceptance of Terms
This Agreement sets forth legally binding terms for your use of the Website. By using the Website, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse the Website) or you are a "Client" (which means that you have purchased one or more of our Services). If you do not accept the terms of this Agreement, you must discontinue use of the Services immediately. We may modify this Agreement from time to time, and such modification shall be effective upon its posting on the Website. You agree to be bound by any modification to this Agreement when you use the Website after any such modification is posted; it is therefore important that you review this Agreement regularly.
2. Your Physical Activity Readiness
Before you can attend any training with Omega Movement you must complete a Physical Activity Readiness Questionnaire (PARQ) . This will be provided at point of booking or before your first attendance. If you have any medical conditions not suitable for exercise then you may be refused to take part in the session without a medical certificate presented on attendance. These include:
- A heart condition where a doctor recommended only medically supervised activity.
- Experienced chest pain brought on by physical activity
- Developed chest pain in the last month
- Loss of consciousness or fall over as a result of dizziness
- Bone or joint problems that could be aggravated by the proposed physical activity
- Been recommended medication for your blood pressure or a heart condition
- Any other advice or reason why you should not exercise without medical supervision
- Currently pregnant or were pregnant in the last six (6) months
- A prolapsed disc or disc bulge
3. Important Liability Statement
The exercise, health information and nutritional videos, programmes and articles provided as part of the Services are demanding. The use of our Services require a high level of responsibility and self-awareness in order to avoid injury. Before using any of the Services, it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well and that the Services are suitable for you. Before commencing any exercise program or nutritional program and before making changes to your existing exercise or nutritional program, you should consult your physician or other qualified Healthcare Provider in order to ascertain whether the programs and changes are appropriate for you. You are responsible for your own safety. A very important part of your own journey is to assume responsibility for your own wellness, your own body and your health. Please listen to your body and when in doubt, hold back on any exercise regime. From time to time instructors may suggest physical adjustments or the use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition. You expressly waive and release any claim that you may have at any time for injury of any kind against Omega Movement Ltd, or any person or entity involved with the Omega Movement Ltd including without limitation its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates and representatives. You assume all risk of injury by using the content and Services. Please do not use the content and Services if you are not willing to accept this responsibility.
No content or other information contained on or provided through the Website or provided by the Omega Movement Ltd by email or in any manner whatsoever should be construed as medical and/or health advice. Always seek the advice of your physician or other qualified Healthcare Provider for answers to any questions you may have regarding a medical or health related condition. Neither the content, other information contained on the Website, nor any other Service offered by or through any teacher of Omega Movement Ltd is intended to be relied upon for medical diagnosis or treatment. Never disregard medical advice or delay in seeking it because of something you have read on the Website.
There is absolutely no guarantee, representation, warranty or undertaking that you will not suffer injury arising out of participation in any physical activity as shown on the Website or that your fitness, health or wellbeing will improve as a result of participation in the Services. Your health and wellness will improve as part of an all-round change in diet and activity level as advised by your Healthcare Provider.
LIABILITY: We try to make sure that all information that we post on the Website (and provided by us to you as part of any Services) is correct, and we will use reasonable care and skill in providing Services to you. As long as we have done that, and subject to the paragraph below, we do not accept any liability for any error or omission and exclude all liability for any action you may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this website (including any articles posted by a third party) or provided through any Service supplied by us to you.
a. You will pay for your package or individual session(s) in full and in advance of the first session. You can pay by credit card, Paypal or bank transfer. If you do not use the 'Buy Now' online payment process via our booking system, Omega Movement shall invoice you for your ordered service. Upon confirmation of receipt of payment, a contract is formed for the Services purchased and you become a Client.
b. All 'Packages' are for a minimum of 2 months. You shall pay for each month in advance and in full. You can transfer credits for sessions to another teacher or practice within your purchased package. Sessions unused at the end of the month can be rolled over to the next month, for one month only.
c. All 'Programs' are for the stated fixed period of time and should be completed within the Program's time-frame. You will need to speak with your Program Teacher about any extension to your Program sessions. It is at your teacher's sole discretion to extend your sessions and Program beyond the stated duration.
d. If for some reason you are unable to attend all of your sessions purchased in a Package or Program for a month or more please contact us at email@example.com to see if we can extend your Package or Program.
e. Studio Bookings. Where your Service requires Omega Movement to hire third party services or venue, Private sessions that take place in third party studios are subject to additional hire charges and terms and conditions. Omega Movement shall confirm such additional terms to you at booking confirmation. These terms form part of your Agreement for Services with Omega Movement.
f. We use a third party booking provider to purchase packages and book Client sessions. You can either use the online booking system directly yourself or contact us to arrange a time for your session(s). You will receive a confirmation email and text once your booking, if you do not receive this or there is an error, please contact us.
g. PRIVATE CLIENT Cancellations only: We get that things happen & you may need to cancel your session.
(i) You will be charged the full fee for the session if you cancel with less than 24 hours notice. We will try to accommodate change dates where over 24 hours notice is given.
(ii) Private sessions in a third party venue shall require over 48 hours notice or else you shall be charged for the studio hire charge.
(iii) We use a booking system that sends automatic reminders via email and text to you about your booked sessions. This allows you to cancel and reschedule your session within the stated periods. You can opt out of the reminders through the system itself or by emailing us, but please note that we use this system so that you can control your schedule.
h. If we cancel. If for some reason we have to cancel your session (group or private) we will transfer your credit to another session, unless you ask us at firstname.lastname@example.org to refund you for that session alone instead.
i. Third party Service Providers. Omega Movement's online training is provided using third party software and internet capability. Please be aware that there may be instances where internet connection or software developments delay or cause a session to be cancelled. We shall endeavour to rearrange your session at a suitable time with you within the next two weeks of the missed date.
5. Image and privacy
a. As a Client you grant Omega Movement Ltd to right to use your image, name and reviews in any visual, audio and other capture that we take during workshops, retreats or classes for the purpose of marketing and promoting Omega Movement across any and all media known present or in the future.
a. We ask that all our instructions uphold our Values in all their work with our Clients. If you do not feel that your teacher meets these values, please contact us and let us know the nature of your concerns.
b. All Clients must uphold the Values in their Sessions and in conduct with us. Should a teacher consider any behaviour by a Client inappropriate, unsafe or misaligned with our Values, the teacher may request to cease working with the Client. In extreme situations, we can terminate the Services with the Client immediately.
c. In the unlikely event that you wish to complain about any aspect of the service provided by Omega Movement you should contact us, as soon as possible, in order to try and resolve the matter on the spot.
7. Statutory Rights and Refunds
The rights of cancellation and refund and any limitation expressed in these terms and conditions do not affect your statutory rights as a consumer. Refunds in relation to Services may only be credited to the credit or debit card originally used to make the purchase. If we are unable to put the refund through on this card for any reason, we will try to contact you to discuss alternative arrangements.
8. Use of this Site Generally
a. You may use the Website for personal and lawful use and in accordance with these terms and you are not allowed to copy or use any material from the Website for any purpose including any commercial purpose including for selling any goods or services.
b. The intellectual property rights in all contents of the Website and supplied as part of the Services, and in the Omega Movement's brands trade marks and logos ("Materials") are owned by Omega Movement or its third party licensors. You acknowledge and agree that all Materials on the Website are made available for limited, non-commercial, personal use only. Except as specifically provided herein or elsewhere on this Website, no Material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without Omega Movement's prior express written permission. You may not add, delete, distort, or otherwise modify the Material. Any unauthorized attempt to modify any Material, to defeat or circumvent any security features, or to utilise the Website or any part of the Material for any purpose other than its intended purposes is strictly prohibited.
c. Please do not use our logo, photographs or wording without obtaining our express permission us first, so please contact us. All use must attribute back to us "[© or TM] 2014 by Omega Movement Limited" and if online please include a hyperlink back to our website.
d. You must not use the Website to post, upload or otherwise transmit material which is obscene or pornographic, threatening, menacing, racist, offensive, defamatory, infringing of any intellectual property or otherwise unlawful, to harass, stalk, threaten or otherwise violate the rights of others, to misrepresent your identity or status, to hack into this Website or any other related computer system, to make excessive traffic demands, deliver viruses or forward chain letters or similar materials that may reasonably be expected to inhibit other users from using and enjoying the Website or any other website or damage or destroy the reputation of Omega Movement or any third party.
e. Omega Movement accepts no obligation to monitor the use of the Website. However, Omega Movement reserves the right to do so and to disclose any information as required by law and/or to remove, refuse to post or to edit any information or materials, to block your access and to take such other action as may be reasonably necessary to prevent any breach of these terms and conditions or any breach of applicable law or regulation. Omega Movement will also, in its absolute discretion, fully co-operate with law enforcement and other relevant authorities with respect to any investigation of suspected unlawful activity or violation of network security.
f. Omega Movement may suspend the operation of the Website for repair or maintenance work or in order to update or upgrade the contents or functionality of the Website from time to time. Access to or use of the Website or any Websites or pages linked to it will be not necessarily be uninterrupted or error free.
9. General Terms
a. Jurisdiction & Governance. These terms and conditions are governed by English law and you and Omega Movement Limited, registered in England & Wales (No. 09500445) at 158 Arnold Road, London, N15 4JH, United Kingdom, and .agree to submit to the exclusive jurisdiction of the English courts in the event of any dispute. This Website and Omega Movement are located in England and in case of any International orders, training, retreats or contracts, this Agreement shall be construed as being performed in England.
b. Amendments. The Company may change these terms and conditions from time to time and will endeavour to notify you of any major changes by posting a message on the Site. By browsing the Site you are accepting that you are bound by the current terms and conditions. You should check these each time you revisit the Site. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter. If any provision of these terms and conditions is found to be unenforceable, this shall not affect the validity of any other provision. The Company may delay enforcing its rights under these terms and conditions without losing them. You agree that the Company may sub-contract the performance of any of its obligations or may assign these terms and conditions or any of its rights or obligations without giving you notice.
c. Third party contributions. Articles on this site may be submitted by third parties and Omega Movement is not able to confirm the accuracy or completeness of such content and is not liable for such articles. Again, this Website does not provide medical advice.
Workplace Wellbeing Clients
10. Terms & conditions will be sent to the appointed person in the company prior to commencing our services. Where group sessions are paid for by the individual staff, a PARQ will be provided with the terms specific to the group. Please be aware that in providing your company our services we will have a non-exclusive right to use your logo on our website as an example Workplace Wellbeing client of Omega Movement.
